Complaint Under Section 154(3) CrPC for Not Registering FIR

Topic: Illegal Collection of Electricity Charges and Police Inaction

On 19th May 2025, senior citizen Kamlakar Shenoy submitted a complaint to the Deputy Commissioner of Police (DCP), Zone 1, demanding registration of an FIR against BEST officials for illegally collecting “wheeling charges” from consumers.

He previously submitted the complaint at Azad Maidan Police Station on 24th March 2025, but no FIR was registered, nor was any written explanation given by the police.

He stated that the law under Section 154(1) CrPC clearly says that if a complaint discloses a serious (cognizable) offence, police must immediately register an FIR. The failure to act violates citizens’ rights and Supreme Court orders.

Shenoy emphasized that higher officers like the DCP must take action directly and cannot just forward the complaint back to junior officers without applying their mind. Doing so is a punishable offence under Section 166A IPC.

The complaint explains that this is a public interest matter involving fraud worth crores of rupees. Shenoy urged the DCP to act urgently and register an FIR as per the law.
